SCHEDULE - Standard composition, diameter and weight of Gibraltar sterling decimal coinage.
AN ACT TO AUTHORIZE THE ISSUE OF COINS BY THE GOVERNMENT OF GIBRALTAR, TO PROVIDE FOR SUCH COINS TO BE LEGAL TENDER FOR PAYMENTS UP TO AMOUNTS SPECIFIED AND FOR MATTERS INCIDENTAL THERETO.
Title and Commencement.
1. This Act may be cited as the Gibraltar Coinage Act, 1990, and shall come into operation on such date as the Governor may by notice in the Gazette appoint.
Issue of Gibraltar coinage.
2. (1) Subject to subsection (2) of this section, the Minister responsible for finance may by notice in the Gazette authorize the issue in sterling currency of coins (hereinafter referred to as “coins”) of such denominations, design, composition, weight and dimensions as shall be specified in the notice.
(2) The design of such coins shall have been approved by the Minister responsible for finance prior to their issue in accordance with subsection (1) of this section.
Standard of coins.
3.(1) All coins shall be of the standard weight, diameter and composition set out in the Schedule to this Act.
(2) In the making of the coins a remedy (that is to say a variation from the standard weight, composition or dimensions so specified) may be allowed in the notice referred to in section 2, such variation not to exceed the appropriate remedy allowance set out in the said Schedule.
Legal tender.
4. The coins shall be legal tender in Gibraltar as follows–
(a) coins of denominations of not more than two pence for payment of any amount up to twenty pence;
(b) coins of denominations of more than two pence but not more than ten pence for payment of any amount up to five pounds;
(c) coins of denominations of more than ten pence but not more than two pounds for payment of any amount up to ten pounds;
(d) coins of denominations of more than two pounds but not more than five pounds for payment of any amount up to fifty pounds;
(e) coins of denominations of more than five pounds but not more than fifty pounds for payment of any amount up to three hundred pounds.
Minister’s power to vary Schedule.
5. The Minister responsible for finance may by notice in the Gazette vary, add to, or delete, any provisions of the Schedule to this Act.
Consequential amendments.
6.(1) Section 5 of the Coinage Act 1870 shall have no effect with respect to any coins issued in pursuance of this Act.
Section 6(2) amends subsections 222(b) and (f) in the Criminal Offences Act.
Demonetisation.
7. The Minister responsible for finance may make rules for the domonetisation of coins issued under this Act.
